How to File a Small Claims Case in the Philippines (2026)

No lawyer required. ₱400,000 ceiling. The fastest way to get a court judgment for a debt, refund, or damages from any company. Pre-filled forms available below.

First hearing typically within 30 days of filing; decision same day as hearing

Step-by-Step Guide

  1. 1
Verify amount is ₱400,000 or below (raised from ₱200,000 in 2022). This covers most individual disputes with GMS or MLhuillier.
  2. 2
Fill out the Statement of Claim (Form 1-SCC) — download from sc.judiciary.gov.ph or your local MTC/MeTC.
  3. 3
Include: your name and address, defendant company's registered address (get this from SEC or DTI), specific amount claimed, and a clear narrative of facts. Attach all supporting documents.
  4. 4
File at the MTC/MeTC in the city/municipality where you reside OR where the company's principal office is located.
  5. 5
Pay the docket fee (₱500–₱1,500 depending on amount; indigents may be exempt).
  6. 6
The court serves summons on the company. A hearing date is set within 30 days.
  7. 7
Both parties appear. No lawyers allowed to represent either side (they may coach outside the courtroom but cannot appear). You present your evidence; company presents theirs.
  8. 8
Judge renders decision on the same day as the hearing.
  9. 9
If you win, a writ of execution can be issued to collect — including from bank accounts.

Frequently Asked Questions

Do I need a lawyer for small claims?

No. The Rules of Procedure for Small Claims specifically prohibit lawyers from appearing as counsel in hearings. You represent yourself. A lawyer can help you prepare your Statement of Claim but cannot appear in court on your behalf.

What if the company doesn't appear at the hearing?

If the defendant (company) fails to appear, the court renders judgment in your favor based on your evidence. This is called a judgment by default.

Can I file multiple small claims against the same company?

You can only file one case per cause of action. However, multiple different customers can each file their own small claims cases independently. When many customers file simultaneously, it becomes extremely costly for the company to defend.

What is the address for Global Mobility Service Philippines for the Statement of Claim?

Use the registered address from their SEC General Information Sheet (GIS), available at sec.gov.ph. Always use the registered business address, not a branch address.
